Unfortunately, no other large mammals will have that option

"Improvements at Land Border Push Smugglers West, to the Pacific" tells the story of migrants who were stranded at sea this week after an attempt to cross the maritime border failed. People are using surfboards, jet skis, and simply swimming across to get to the US. The piece really focuses on the new surge in ocean-based illegal entry, but leaves the obvious unstated: The Border Wall IS NOT WORKING!

The high-tech surveillance, the reinforced steel walls, and the Minutemen have only succeeded in pushing traffic to new and improved outlying areas, not in stopping immigration.

Well, duh. Because the border wall idea is insane.

I know, I know, and anyone else who lives along the border knows that the wall won't work. But it's a damn shame that it will work to keep in/out wildlife. For them, there are no life-vests.

Chin up, kids.

One fundamental problem with the border wall that is currently under construction in California and Arizona and will break ground (literally) in Texas in the next month or so is the fact that DHS does not have to obey any of our nation’s environmental laws. Section 102 of the Real ID Act says, “Notwithstanding any other provision of law, the Secretary of Homeland Security shall have the authority to waive all legal requirements such Secretary, in such Secretary’s sole discretion, determines necessary to ensure expeditious construction of the barriers and roads under this section.” Department of Homeland Security Secretary Chertoff has already waived as many as 19 federal laws, including the Endangered Species Act, the Migratory Bird Treaty Act, and the National Environmental Policy Act, to build walls in California and Arizona. The Defenders of Wildlife and Sierra Club have petitioned the Supreme Court to rule on the constitutionality of Chertoff’s power, but if the court eventually takes up the case it will be too late for much of the borderlands.

Yes, thank you, we know all about Section 102 here at DL- please read through our other posts. We're furious about it too, and/but the Texas No Border Wall Coalition is one of our bright hopes for change.

Please note that Chertoff has to invoke the REAL ID waivers- DHS doesn't automatically just "have them" so until you hear otherwise, assume that they must comply with all the environmental laws, and participate in planning processes underway. Resist!
